This position exists to provide legal advice and oversight of internal litigation activities for matters originating out of the Minnesota Department of Human Services (DHS), Office of Inspector General (OIG), Background Studies Division, and provide legal advice and consultation on matters related to background studies laws and functions. The position also exists to determine, secure, and allocate resources within a unit of the OIG Legal Division, and to provide legal advice to senior leadership to accomplish the objectives of the OIG Background Studies Division. This position also supervises and develops staff for one of three units in the OIG Legal Counsel’s Office.
The OIG consists of:
The Background Studies Division that performs over 320,000 background studies per year on virtually all individuals who provide health care or human services in Minnesota, on behalf of DHS, MN Dept of Health, and MN Dept of Corrections, district courts, the MN Supreme Court, MNSCU, MNsure, Tribal governments and more, through relationships with MN Dept of Public Safety-Bureau of Criminal Apprehension, the FBI, all 87 county adult and child protection agencies in Minnesota, and all these corresponding agencies in the other 49 states as well;
The Program Integrity and Oversight Division that investigates unauthorized access to many of the state’s publicly funded health care, cash assistance, and child care programs. The scope includes over 100 provider types who may be billing inappropriately as well as individuals who may misrepresent their eligibility to access these program funds and services;
The Licensing Division that performs regulatory oversight duties for approximately 24,000 service providers investigating complaints and maltreatment allegations;
The Legal Division that provides legal advice, advocacy, and oversight of all legal functions in the Financial Fraud and Abuse Investigations Division, the Background Studies Division, and the Licensing Division; and
Divisions providing data and operational services to the OIG.
Responsibilities include but are not limited to:
Supervise attorneys in the Background Studies legal unit.
Direct and coordinate legal advice and litigation.
Determine allocation of unit resources.
Direct work and monitor production and performance of unit staff on background studies-related matters and their intersection with other areas of DHS.
Interact with DHS senior management, OIG executive management and staff, DHS General Counsel’s Office, Minnesota Attorney General’s Office, and other internal and external partners regarding criminal, civil and administrative actions involving the OIG.
Minimum Qualifications

JD degree from an ABA accredited law school;
Current license and in good standing to practice law in Minnesota;
At least five (5) years’ experience as a practicing attorney in an area of law related to the position with at least one (1) of the years working as a supervisor or in a leadership/lead role; and
Knowledge and experience with state and federal data privacy laws as they relate to human services programs.
Experience must demonstrate the following:
Strong legal research, analysis, and writing skills;
Building and maintaining good working relationships with internal and external stakeholders;
Providing legal advice to executive leadership on diverse and complex human services and data privacy matters;
Supervision of staff including mentoring and fostering professional development or serving in a lead/leadership role; and
Experience in five or more of the following areas of laws related to the position:

Minnesota Statutes Chapter 152 (Controlled Substances Act)
Minnesota Statutes Chapter 609A (Adult Expungements)

Minnesota Statutes section 256.045 (Fair Hearings)
Minnesota Statutes Chapter 14 (Contested Case Hearings)
Minnesota Statutes Chapter 13 (Government Data Practices Act)
Preferred Qualifications
Ability to identify Office of Inspector General (OIG)-wide implications of litigation and legal issues arising in the Background Studies Division and appropriately engage OIG leadership, including the Chief Legal Counsel and Deputy Counsel, to develop comprehensive solutions.
Ability to advise on the development of legislation and legal policy affecting the Background Studies Division and to identify OIG-wide and agency-wide implications.
Knowledge of qualitative and quantitative analysis sufficient to evaluate program results and develop protocols to enhance outcomes.
Knowledge of state legislative process.
Demonstrated skill and ability to identify system-level and cross-divisional problems and to work cooperatively to develop and implement solutions.
Demonstrated transition/change management skills that promote successful development and implementation of solutions in cooperation with others.
Ability to recruit, select, retain, and develop qualified individuals who are internally motivated.
Leadership skills and ability to motivate and develop staff to excel at job duties.
Ability to provide effective presentations.
Variety of experiences working effectively with others from different backgrounds and cultures.
