In the 2023 legislative session, the Governor’s Office, Minnesota legislature, and leaders for children and families worked in partnership to pass legislation establishing the Department of Children, Youth, and Families (DCYF) to create a sustainable, public face for children’s issues in state government. This new cabinet-level agency brings together programs centered on children and families, including child care and early learning, child support, child safety and permanency, economic support and food assistance, and youth opportunity. This position will become a part of DCYF.

As a Staff Attorney, you will provide critical support to the Child Support Division (Division) management team in managing and coordinating the state supervision of the Minnesota Child Support Program. This position is on the Division’s Policy & Planning team which develops and communicates program policy, coordinates the Division’s legislative activities, and builds and maintains relationships with the child support professional community and program stakeholders. Team members are responsible for researching and analyzing child support policy and law; maintaining the Child Support State Plan; tracking and managing lawsuits and administrative appeals associated with the program; and monitoring changes in public policy and the law regarding child support to determine impacts on the Division. The team is also responsible for coordinating with other program divisions within the Children and Family Services Administration, other state agencies, and partners and stakeholders. Additionally, the team works closely with MN.IT at DHS on automation of policy and with other divisions across the Department as needed. As a recognized subject matter expert, this position is responsible for providing legal and policy support on issues related to the federal and state child support program with both internal and external audiences.

Responsibilities include but may not be limited to:

  • Perform legal research and analysis on diverse and complex child support and child support related issues.

  • Interpret IV-D program requirements to ensure all division activities are performed in accordance with applicable legal and policy requirements.

  • Analyze state and federal case law, statutes, rules, and regulations and provide recommendations to division management regarding legal interpretation of this material and what impact it may have on program policy and procedure, including equity impacts with a specific focus on the impacts on communities experiencing inequities.

  • Draft policy and legal memoranda summarizing legal and other research findings and analysis.

  • Review, analyze, and provide responses for legal and policy issues and questions sent by county child support offices to the Division Policy Help Desk.

  • Developand help implement statewide child support policies.

  • Develop legislativeproposals, draft legislation and support the Division’s legislation process.

  • Act as a liaison for the Division with other DHS programs and state agencies, other branches of state government, representatives of county agencies, various advocacy and community organizations, and the federal government.

Minimum Qualifications

  • JD degree from an ABA accredited law school;

  • Current license and in good standing to practice law in the State of Minnesota; and

  • At least 1 year experience as a practicing attorney in child support, or related area of law; and

  • Demonstrated knowledge and experience conducting legal research, writing and analysis.

Preferred Qualifications

  • Experience working with other state agencies; the Legislature, the legal professional community, advocacy groups, and the public.

  • Knowledge of and previous experience working with the child support state statutes and federal laws and regulations.

  • Experience planning and delivering complex legal information to non-legal audiences.

  • Experience in data privacy and/or public procurement, grant agreements, and contract law.

  • Variety of experiences working effectively with others from different backgrounds and cultures.
