Direct Care and Treatment (DCT) is seeking an individual to join our DCT General Counsel’s Office for an exciting and rewarding opportunity as our DCT Chief Privacy Official! This position will provide legal advice and counsel on enterprise-wide and inter-agency legal and compliance matters affecting DCT with expertise in privacy and security matters. This position will serve as the Chief Privacy Official for the entire DCT, overseeing the development, implementation, maintenance of and adherence to privacy and security policies and procedures. This position will oversee the permitted and safe use of protected data, including public, nonpublic, private, and confidential data under the Minnesota Government Data Practices Act (MGDPA) as well as protected health information (PHI) and other highly regulated data, in compliance with HIPAA, IRS and SSA requirements, and other state and federal applicable laws.

This position will supervise staff within the DCT General Counsel Office as well as mentor a team of staff within the business areas who will provide advice and training to Department managers, directors, executive management, and staff on a variety of complex legal issues, specifically privacy and security issues.

Primary Responsibilities:

  • Advise and assist the General Counsel of DCT and Senior Counsel with legal, compliance, and other work on matters pertaining to data privacy and security.

  • Provide legal guidance to DCT managers, directors, and executive leadership on related complex legal and compliance issues focusing on the area of data privacy and data security.

  • Counsel and advise the Department in complying with applicable state and federal laws, including data breach analysis, incident response, and communications with federal and state regulators.

  • Collaborate with DCT partners, contractors, MNIT, and other agency General Counsels on strategic data protection, data sharing, and data management initiatives and projects.

  • Lead and advise DCT concerning implementation of and compliance with DCT policies.

  • Advise on policy and legislative initiatives.

  • Develop and provide legal training to DCT leadership and staff on privacy and security laws and issues.

Minimum Qualifications

JD degree from an ABA accredited law school;

Current license and in good standing to practice law in Minnesota;

Seven (7) years’ experience as a practicing attorney. Experience must demonstrate the following:

  • Knowledge and experience with data privacy and data security.

  • Knowledge and experience with state and federal data privacy laws as they relate to human services programs.

  • Demonstrated experience building and maintaining good working relationships with internal and external stakeholders.

Experience must also include:

  • One (1) year experience as a supervisor or in a leadership role in an area of law related to the position.

  • Providing legal advice to executive level leadership on complex legal issues with broad impact.

  • Strong legal research, analysis, writing, and advising skills.

  • Supervision of legal staff including mentoring and fostering professional development.

Preferred Qualifications

  • Public Sector privacy and security experience.

  • Experience with Minnesota Government Data Practices Act, Health Insurance Portability and Accountability Act, and Health Information Technology for Economic and Clinical Health Act

  • Litigation experience.

  • Demonstrated ability to provide leadership through change and leadership in high profile matters.

  • Demonstrated ability to adapt the provision of legal services, including organizational structure of legal teams, to meet client needs.

  • Demonstrated strong emotional intelligence, strategic leadership, change management, and diversity equity and inclusion skills.

  • Demonstrated ability to analyze business and performance data to identify redundancies, gaps, and inefficiencies, and introduce and implement business process changes that will streamline and improve the business.

  • Demonstrated ability to identify common ground for parties with varied interests and build consensus toward solutions.

  • Demonstrated ability to communicate effectively with a large and varied constituency, including legislators and legislative staff, the Attorney General’s Office, state local and federal agencies, professional and advocacy groups, as well as the general public.

  • Demonstrated ability to maintain composure and convey competency, equanimity, and collaboration in stressful situations.

  • Experience working with an agency or organization led by an executive board.
