Job Description
As Legal Counsel for Retail, you will provide strategic legal advice and counsel to internal business partners with respect various retail and healthcare initiatives. You will identify business and legal risks and provide solutions which balance legal issues and business objectives. You will be primarily responsible for the legal and regulatory review of new and innovative products, from concept inception, regulatory analysis, to review of marketing claims. Additionally, you will be responsible for providing detailed guidance on state and federal laws and regulations. You will be expected to develop a keen understanding of operational systems relevant to the Retail and Merchandising teams, and work diligently to develop and maintain positive relationships with clients at all levels of the organization. To be successful in this role, you will possess:• Superior writing and communication skills, exceptional organizational skills, and strong attention to detail.• The ability to work collaboratively in a large, complex corporate structure, and to work sensitively with confidential matters.• Independent work style and ability to anticipate issues and create and implement methods for optimizing results and minimizing risks.• Conduct in-depth analysis and provide detailed guidance related to federal and state regulations for new and developing business initiatives. • Initiative, drive and self-confidence.• Expertise in FDA regulation, including product clearances and approvals, reporting requirements, recalls, and responding to warning letters, FTC enforcement actions, investigations by state attorneys general, and challenges brought before the National Advertising Division (NAD) of the Better Business Bureau.• Extensive experience in reviewing product labels, marketing claims, and promotional campaigns to ensure legal and regulatory compliance with FDA and FTC requirements, as applicable.• Ability to develop a deep understanding of the business and operational goals of assigned internal clients and work diligently to develop and maintain positive relationships with clients at all levels of the organization.• Comfortable in a fast-paced environment and successfully manage many projects -- whether large or small, complex or simple -- simultaneously.Research and analyze retail and healthcare laws and regulations that impact new, developing, and established retail strategic initiatives, including marketing, merchandising, and other consumer programs.Review, evaluate, and interpret laws and regulations applicable to Retail products, services, and initiatives and communicate guidance to Legal, Business, and Compliance colleagues. Advise clients on bringing new and innovative products to market, including FDA product clearances and approvals.Consult on strategic marketing initiatives in close partnership with Retail Legal and Compliance teams to ensure compliance with all applicable laws and regulations. Review product labeling and marketing claims for truthfulness and accuracy and compliance with laws and regulations, including FDA, FTC, etc. Respond to inquiries, investigations, and Warning Letters from FTC, FDA, state governmental agencies, etc.Work on special projects as requested by the Retail business team to evaluate regulatory risks associated with new products or product lines.
Pay Range
The typical pay range for this role is:
Minimum: 140,000
Maximum: 280,000
Please keep in mind that this range represents the pay range for all positions in the job grade within which this position falls. The actual salary offer will take into account a wide range of factors, including location.
Required Qualifications
-Juris Doctor from ABA-accredited institution required; Bar admission in good standing-5+ years legal experience-3+ years of expertise advising on FDA regulation-3+ years of experience advising on healthcare or retail issues-Ability to travel up to 10%

• Superior oral and written communication skills required; • High level of interpersonal skills and ability to manage multiple client areas required; • Superior problem-solving skills required• Expertise providing legal research and analysis in the retail healthcare industry • Direct experience advising business clients leading product and strategic initiatives in a fast past innovative environment
Education
Juris Doctor from ABA-accredited institution required
